Standard Sales Conditions for Consumer Purchases of Goods over the Internet 

Introduction 

This purchase is regulated by the Standard Sales Conditions for Consumer Purchases of Goods over the Internet, given below. Consumer purchases via the Internet are regulated primarily by the Contracts Act, the Consumer Purchases Act, the Marketing Control Act, the Cancellation Act and the E-Commerce Act, and these laws provide consumers with man- datory rights. The terms of the contract are not to be understood as a limitation on legal rights,but present the parties most important rights and duties in regard to the purchase. 

The Sales Conditions have are based on recommendations from the Norwegian Consumer Authority. 

 

1 Contract

The contract consists of these Sales Conditions, information given in the ordering solution, and any specially agreed conditions. In the event of a conflict between pieces of information, precedence goes to what has been specially agreed between the parties, as long as this does not conflict with mandatory legislation. In addition, the contract will be complemented by relevant statutory provisions that regulate the purchase of goods between traders and consumers.

 

2 Parties

The seller is NEW&UNIK JEWELRY LYTKO, Sentrumsgata 22, 2265 Namnå, Norway, info@newunikjewelry.com, org. number 936938841, and is designated in the following as the Seller. 
The purchaser is the consumer who places the order, and is designated in the following as the Purchaser. 
The Purchaser confirms having reached the legal age of majority in their jurisdiction (in Norway, this is 18 years) to enter into a binding agreement. 

 

3 Price 

The stated price for the good and services is the total price to be paid by the Purchaser. 
Note on Taxes: The prices in the online store do not include Value Added Tax (VAT), as the Seller is not registered in the VAT Register. For international sales, no Norwegian VAT is charged. However, the Purchaser is personally responsible for the payment of any local VAT, customs duties, and import fees imposed in the destination country upon arrival. 

 

 4 Conclusion of contract 

The contract is binding for both parties as soon as the Purchaser has sent the order to the Seller. 

However, a party is not bound by the contract if there are orthographical or typological errors in the offer from the Seller in the ordering solution of the online shop or in the Purchaser’s order, and the other party realised or should have realised that such an error was present. 

 

 5 Payment

The Seller may charge the Purchaser for the good from the time it is sent from the Seller to the Purchaser. 

Payment is made securely via PayPal. The amount is reserved on the Purchaser's account upon ordering, and the Seller charges the account only when the goods are shipped. 

 

6 Delivery

Delivery has occurred once the Purchaser or his/her representative has taken possession of the item. If the delivery time is not stated in the ordering solution, the Seller shall deliver the good to the Purchaser within a reasonable time frame and no later than 30 days after the order is placed by the customer. The goods shall be delivered to the Purchaser unless other special arrangements are made between the parties.  

For international shipments, customs processing in the destination country may lead to additional delivery time for which the Seller cannot be held responsible 

 

 7 Product risk 

Product risk is assumed by the Purchaser as soon as the item is taken over by the Purchaser or his/her representative in accordance with Section 6. 

 

 8 Right to cancel

Unless the contract is exempt from the right to cancel, the Purchaser may cancel the order in accordance with the Cancellation Act. The Purchaser must give the Seller notice within 14 days from the date the deadline begins to run. If the deadline ends on a Saturday, Sunday, or public holiday, it is extended to the nearest business day. 

  • In the purchase of individual goods, the cancellation period will begin on the day after the good is/goods are received. 

  • If a subscription is being sold, or the contract contains the regular delivery of identical goods, the period begins on the day after the first shipment is received. 

  • If the purchase consists of several deliveries, the period will begin on the day after the final delivery is received. 

 Notification of the use of the right of withdrawal must be sent by e-mail to info@newunikjewelry.com. For the fastest possible processing, please state the order number in the subject field. If you have any questions before returning, the same e-mail address can be used for guidance. 

The cancellation period will be extended to 12 months after the end of the original period should the Seller not inform the Purchaser of the right to cancel and the standard cancellation form before the conclusion of the contract. This will also apply if information on terms and conditions, time limits and procedures for exercising the right to cancel is insufficient. However, if the trader gives this infor- mation during these 12 months, the cancellation pe- riod ends 14 days after the day the Purchaser received the information. 

When the right to cancel is exercised, the good must be returned to the Seller within a reasonable amount of time and no later than 14 days after no-tice has been given on the intention to exercise the right. The Purchaser must cover the direct costs associated with returning the good, unless otherwise agreed or the Seller has not informed the Purchaser that he/she has to cover the return costs. The Seller may not set fees for the Purchaser’s use of the right to cancel. 

The Purchaser may check or test the good in an appropriate manner in order to determine the nature, properties and function of the good without affecting the right to cancel. If the checking or testing goes beyond what is reasonable and ne- cessary, the Purchaser may be responsible for any reduction in the good’s original value. 

The Seller is obligated to pay back the purchase sum to the Purchaser without undue delay, and no later than 14 days after the Seller received notice on the Purchaser’s decision to exercise the right to cancel. The Seller has the right to retain the repay- ment until it has received the goods from the Pur- chaser, or until the Purchaser has documented that the goods have been sent back. 

Important for International Returns: 

When returning goods from countries outside of Norway, the package must be clearly marked "RETURNED GOODS" on the customs declaration. This is necessary to avoid customs fees and VAT when the goods re-enter Norway.

Note: Failure to collect the package without giving notice is not considered a valid exercise of the right of withdrawal. 

 

9 Delays and non-delivery: the Purchaser's rights and time limit to make claim 

If the Seller fails to deliver the goods or delivers them late according to the Contract between the parties, and this is not due to the Purchaser or circumstances on the Purchaser’s side, the Purchaser may, in accordance with the rules in Chapter 5 of the Consumer Purchases Act, withhold the purchase price, demand performance, terminate the Contract, and/or claim compensation from the Seller. 

For evidentiary purposes, claims for breach of contract should be made in writing (e.g., via e-mail). 

Performance 

The Purchaser may uphold the purchase and demand performance from the Seller. However, the Purchaser cannot demand performance if there is an obstacle that the Seller cannot overcome, or if performance would cause such great inconvenience or cost to the Seller that it is significantly disproportionate to the Purchaser’s interest in the Seller performing. Should the difficulties cease within a reasonable time, the Purchaser may still demand performance. 

 The Purchaser loses the right to demand performance if he or she waits an unreasonably long time to bring the claim. 

 Termination 

If the Seller does not deliver the goods at the time of delivery, the Purchaser shall urge the Seller to deliver within a reasonable additional deadline for performance. If the Seller does not deliver the goods within this additional deadline, the Purchaser may terminate the Contract. 

 However, the Purchaser may terminate the Contract immediately if the Seller refuses to deliver the goods. The same applies if delivery at the agreed time was essential for the conclusion of the Contract, or if the Purchaser has informed the Seller that the time of delivery is essential. 

 If the item is delivered after the additional deadline set by the consumer, or after the delivery time that was essential for the conclusion of the Contract, a claim for termination must be asserted within a reasonable time after the Purchaser became aware of the delivery. 

 Compensation 

The Purchaser may claim compensation for any loss suffered as a result of the delay. This does not apply, however, if the Seller proves that the delay is due to an obstacle beyond the Seller’s control that could not reasonably have been taken into account at the time of the Contract, avoided, or overcome the consequences of. 

 Special Provisions for International Shipments 

For shipments abroad, stated delivery times are indicative. The Seller is not responsible for delays caused by customs processing or local postal conditions in the destination country. Such circumstances are considered obstacles outside the Seller’s control. 

 

10 Defective goods: the Purchaser's rights and time limit to give notice 

If there is a defect in the goods, the Purchaser must, within a reasonable time after it was discovered or should have been discovered, notify the Seller that he or she will invoke the defect. The Purchaser has always complained in time if it occurs within 2 months from the time the defect was discovered or should have been discovered. Complaints can be made no later than two years after the Purchaser took possession of the goods. If the goods or parts of them are intended to last significantly longer than two years, the complaint deadline is five years. 

If the goods have a defect and this is not due to the Purchaser or circumstances on the Purchaser's side, the Purchaser may, in accordance with the rules in the Consumer Purchases Act Chapter 6, withhold the purchase price, choose between repair and replacement, demand a price reduction, demand cancellation of the contract and/or claim compensation from the Seller. 

Complaints to the Seller should be made in writing. 

Repair or replacement 
The Purchaser can choose between claiming the defect repaired or the delivery of equivalent items. The Seller may nevertheless oppose the Purchaser's claim if the execution of the claim is impossible or causes the Seller unreasonable costs. Repair or replacement shall be carried out within a reasonable time. The Seller is generally not entitled to more than two attempts at a remedy for the same defect. 

Price reduction 
The Purchaser may demand an appropriate price reduction if the goods are not repaired or replaced. This means that the ratio between the reduced and agreed price corresponds to the ratio between the item's value in defective and contractual condition. If special reasons justify it, the price reduction may instead be set equal to the defect's significance for the Purchaser. 

 Termination  

If the goods are not repaired or replaced, the Purchaser may also cancel the purchase when the defect is not immaterial. 

SPECIAL PROVISIONS REGARDING NATURAL MATERIALS AND CRAFTSMANSHIP

The jewelry in the store is handcrafted and produced using a variety of materials, including but not limited to glass beads, natural stones, pearls, and various embroidery elements. Since natural materials and manual techniques are used, natural variations in color, shape, pattern, and surface may occur compared to the images in the online store. Such natural differences, as well as minor asymmetries resulting from the handcrafted process, are not considered a defect in the item and do not provide grounds for a complaint by the Purchaser. 

 RESERVATION REGARDING COLOR REPRODUCTION

The Seller strives to display the colors of the jewelry as accurately as possible. However, the Seller cannot guarantee that the Purchaser's computer monitor or mobile screen reproduces the colors completely correctly. Minor deviations in shade between the image on the screen and the physical product are not considered a defect in the item. 

 NORMAL WEAR AND TEAR AND MAINTENANCE 
The right to complain only covers manufacturing defects and does not include normal wear and tear resulting from daily use. Damage occurring as a result of careless handling, impact or fall (such as dropping the item on hard surfaces), incorrect storage, or the jewelry being exposed to water, perfume, chemicals, direct sunlight (which may cause fading/discoloration), or extreme temperatures, is not considered a defect in the item. Natural oxidation of metal parts over time is also considered normal wear and tear and not a manufacturing defect. 

 PRODUCT INFORMATION: 
Since the jewelry contains small parts, they are not intended for children and must be kept out of their reach. The Purchaser is personally responsible for reading the product description carefully before purchase to ensure that the product and materials are suitable for their use. 

 

11 Seller's rights in case of Purchaser's breach of contract 

In the event of a breach of contract by the Purchaser, the rules of the Norwegian Consumer Purchases Act Chapter 9 shall apply. The Seller reserves the right to withhold the goods or terminate the contract if the payment is not approved, is withdrawn, or if the Purchaser otherwise breaches the terms of the contract. 

 Fee for uncollected goods 

Failure to collect the package from the pickup point is not considered a valid exercise of the right of withdrawal. The Seller reserves the right to charge the Purchaser for the actual costs incurred (round-trip shipping and handling) to deliver the goods. This amount will be deducted from the refund of the purchase price. Such a fee cannot be charged to persons under the age of 18, as the contract can only be entered into by adults of legal age. 

 

12 Warranties 

Warranties given by the Seller or manufacturer give the Purchaser additional rights beyond those mandatory rights he/she has by mandatory law. Thus, a warranty does not imply any limitation on the Purchaser’s right to give notice or make claims in case of delay or defect according to Sections 9 and 10. 

 

13 Personal data 

The Seller is the party responsible for handling collected personal data. Unless the Purchaser consents otherwise, the Seller may only obtain and store whatever personal data is necessary for the Seller to complete its duties according to the contract. The Purchaser’s personal data shall only be given to others if this is necessary for the Seller to fulfil the contract with the Purchaser, or in cases where this is required by law. 

 

14 Conflict resolution 

If an amicable settlement is not reached after mediation in the Consumer Authority, the parties may request that the Consumer Authority refers the dispute to the Consumer Disputes Commission. Decisions made by the Consumer Disputes Commission become legally binding one month after notification. Before the decision becomes legally binding, the parties may bring up the dispute before the District Court (Tingretten). The case shall, as a general rule, be brought before the court in the legal district where the Purchaser resides.
